Terms and Conditions – KLYSTRO SUPPLY

Article 1 - Definitions

Throughout these Terms of Service, the following terms shall have the meanings ascribed to them:

• Supplemental Agreement: An agreement wherein the Customer acquires products or digital content in connection with a Distance Agreement, and these goods or content are supplied by the Merchant or a third party based on an arrangement between that third party and the Merchant.
• Reflection Period: The timeframe within which the Customer may exercise their right of return.
• Customer: The natural person who is not acting for purposes related to their trade, business, craft, or profession.
• Day: A calendar day.
• Digital Content: Data produced and supplied in digital form.
• Durable Medium: Any means, including email, that enables the Customer or Merchant to store information addressed personally to them in a way that is accessible for future reference for a period adequate for the purposes of the information and which allows the unchanged reproduction of the stored information.
• Right of Return: The Customer’s option to cancel the Distance Agreement within the Reflection Period.
• Merchant / Klystro Supply: The legal entity offering products, digital content, and/or services to Customers at a distance.
• Distance Agreement: An agreement concluded between the Merchant and the Customer within the framework of an organized system for distance selling of products, digital content, and/or services, where exclusive or partial use is made of one or more means of distance communication up to and including the time at which the agreement is concluded.
• Terms of Service: The present General Terms and Conditions of the Merchant.

Article 3 - Applicability

These Terms of Service govern all offers from Klystro Supply and every Distance Agreement concluded between the Merchant and the Customer.

Before any Distance Agreement is finalized, the text of these Terms of Service will be made available to the Customer. It will be provided in a way that allows the Customer to easily store it on a Durable Medium.

Should any provision in these Terms of Service be or become void or invalid, the remainder of the provisions shall remain in full force and effect. The void provision will be replaced by a valid provision that reflects the original intent as closely as possible.

Article 4 - The Offer

If an offer is time-sensitive or subject to conditions, this will be explicitly stated in the offer.

All offers are made without obligation. The Merchant is entitled to change and adapt the offer at any time.

The Merchant endeavors to provide descriptions and images that are as accurate as possible. However, all product images are for illustrative purposes. Apparent mistakes or errors in the offer do not bind the Merchant.

Every offer will contain such information that it is clear to the Customer what rights and obligations are attached to accepting the offer.

Article 5 - The Agreement

The agreement is concluded, subject to the provisions of this article, at the moment the Customer accepts the offer and complies with the corresponding conditions.

If the Customer has accepted the offer electronically, the Merchant will immediately confirm receipt of the acceptance of the offer electronically. The Merchant employs appropriate technical and organizational measures to secure the electronic transfer of data and ensures a safe web environment.

The Merchant may, within statutory frameworks, inquire whether the Customer can meet their payment obligations. If, based on this inquiry, the Merchant has good grounds not to enter into the agreement, they are entitled to refuse an order or request, or to attach special conditions to the implementation.

Article 6 - Right of Return

The Customer may dissolve an agreement regarding the purchase of a product during a Reflection Period of 30 days without giving any reason. The period begins on the day after the Customer has received the product.

During the Reflection Period, the Customer shall handle the product and its packaging with care. To exercise their right of return, the Customer must notify the Merchant within the 30-day period and return the product within 14 days of notification.

Article 7 - Costs in Case of Return

The Customer is responsible for the direct costs of returning the product, unless the product was defective or incorrect upon receipt.

The Merchant shall reimburse all payments from the Customer, including any delivery costs charged by the Merchant for the original shipment, within 10 business days following the day on which the Merchant receives the returned product.

Article 8 - Exclusions from the Right of Return

The Right of Return is excluded for products that are custom-made, perishable, or for items where a hygiene seal has been broken after delivery.

Article 9 - Pricing

During the validity period mentioned in the offer, the prices of the products will not be increased, except for price changes due to changes in tax rates.

All prices are stated in US Dollars (USD). The Merchant is not liable for obvious pricing or typographical errors.

Article 10 - Warranty and Conformity

The Merchant warrants that the products meet the specifications stated in the offer and the reasonable requirements of soundness and/or usability.

Any defects must be reported in writing within four weeks of delivery. This warranty does not apply if a defect is caused by the Customer through misuse, modification, or improper handling of the product.

Article 11 - Delivery and Execution

The Merchant will take the greatest possible care when receiving and executing orders for products.

The place of delivery is the address that the Customer has made known to the Merchant. Risk of damage and/or loss of products rests with the Merchant until the moment of delivery to the Customer.

Article 12 - Payment

Unless otherwise stipulated, payments must be made using the methods provided during the checkout process. The Customer has the duty to report inaccuracies in provided or stated payment data to the Merchant without delay.

Article 13 - Complaints Procedure

Complaints about the performance of the agreement must be submitted to the Merchant in a fully and clearly described manner via contact@klystrosupply.com.

The Merchant will provide a substantive response within 3 business days.

Article 14 - Governing Law

Agreements between the Merchant and the Customer to which these Terms of Service relate are exclusively governed by the laws of the United States.
